Terms of Service — Digital Internship

1) Overview

These Terms of Service (“Terms”) govern your access to and use of the website at https://digitalinternship.ai and the purchase and use of Digital Internship — a task-based training platform with simulated work environments, AI-assisted teammates, scoring, and portfolio tools (collectively, the “Service”), operated by Vorkis LLC (“Digital Internship”, “we”, “us”, “our”). By accessing the Service or purchasing a plan, you agree to these Terms. If you do not agree, do not use the Service.

Institutional, enterprise, or government deployments may also be governed by a separate order form, data processing agreement, or master services agreement. If there is a conflict, the signed agreement controls for that customer.

2) The Service

Digital Internship provides digital simulations and related tools that help learners practise professional tasks, receive feedback, build portfolios, and — where configured — share verified performance records with educators, institutions, or employers. Features vary by plan and programme. The marketing website describes the Service; the live product is accessed through authenticated platform environments (including sign-in at auth.intela.cloud).

3) Eligibility & Accounts

You must be of the age of majority in your jurisdiction to purchase an individual plan, or have consent from a parent, guardian, or authorised institution where applicable. If you create an account, you are responsible for maintaining its security and for all activities under it. You must provide accurate information and notify us promptly of unauthorised access.

4) Pricing, Payment & Taxes

Individual and institutional plans are described on our Pricing page and may change from time to time.
Subscriptions renew monthly or annually according to the billing cycle selected at purchase, unless cancelled in accordance with these Terms or your agreement.
Payments are processed by third-party payment processors. We do not store full payment card details.
Prices may not include applicable taxes, duties, or bank fees. Where required, taxes will be calculated and shown at checkout.

5) Delivery & Access

After successful payment or activation by an institution, digital access to the Service is granted through your account. If you do not receive access within a reasonable time after payment, contact support@digitalinternship.com.

6) Refunds & Cancellations

You may cancel a subscription according to the cancellation mechanism provided at purchase or in your account settings. Cancellation stops future billing; access may continue until the end of the current paid period unless otherwise stated.
Because the Service includes digital content and personalised learning activity, fees are generally non-refundable once access is delivered, except where required by applicable law or expressly stated at purchase.
Refunds, when eligible, are processed through the original payment method and subject to the payment processor's timelines.
For EU/UK consumers: by starting immediate access to digital content or a subscription, you may explicitly consent to performance starting before the 14-day withdrawal period ends and acknowledge that you may lose your right of withdrawal once access begins, as permitted by law. If we fail to deliver access you paid for, you remain entitled to a refund or remedy.

7) Acceptable Use

You may not:

Use the Service unlawfully or in violation of applicable export, sanctions, or privacy laws;
Reverse engineer, scrape, or attempt to bypass security or usage limits;
Share, resell, or sublicense access except as permitted by your plan or agreement;
Upload malware or interfere with other users or the integrity of simulations;
Misrepresent your identity, affiliation, or performance records;
Use the Service to generate unlawful, harmful, or infringing content.

8) Intellectual Property & License

All platform software, simulations, scoring methodology, branding, and materials are owned by Vorkis LLC or its licensors. We grant you a personal, non-exclusive, non-transferable licence to use the Service for your individual learning or, for institutional users, as authorised under your programme. Commercial redistribution of platform content is prohibited without written permission.

You retain ownership of original work you create within the Service, subject to the licence you grant us to host, process, score, and display outputs as needed to operate the Service and as configured in your account or institutional agreement.

9) User Inputs & Learning Data

To operate simulations and scoring, you may submit information about your goals, background, task responses, and collaboration activity. You represent you have the right to provide such information. We may use your inputs to deliver the Service, generate feedback and portfolio artefacts, and improve the Service (see our Privacy Policy).

10) Third-Party Services

The Service integrates third-party providers (e.g., payment processors, hosting, analytics, authentication, AI inference, and form delivery). We are not responsible for third-party terms or failures. Your use of third-party services is governed by their terms.

11) Modifications to the Service and Terms

We may update the Service and these Terms. We will post the new effective date and, for material changes, provide reasonable notice (e.g., email or in-product notice) at least 15 days before they take effect. Continued use after changes become effective constitutes acceptance.

12) Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee that Digital Internship will secure employment, admission, certification, or specific learning outcomes. Simulations approximate professional environments but are not a substitute for employment, licensure, or regulated training where required by law.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of Liability

To the maximum extent permitted by law, Vorkis LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability for any claims relating to the Service shall not exceed the greater of USD $100 or the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or where such limitation is prohibited by law.

14) Indemnification

You agree to indemnify and hold harmless Vorkis LLC from claims arising out of your misuse of the Service or violation of these Terms or applicable law.

15) Termination

We may suspend or terminate access if we reasonably believe you violated these Terms or applicable law. You may stop using the Service at any time. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) survive termination.

16) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, USA, without regard to conflicts of law principles. Exclusive jurisdiction and venue lie in the state or federal courts located in Texas, USA. Mandatory consumer protection laws of your country of residence remain unaffected.

17) Consumer Dispute Information (EU/UK)

EU consumers may access the European Commission's ODR platform for online dispute resolution. Using ODR does not limit your statutory rights.
